Prevention is always less painful than a cure especially
when considering finance, legal matters and most importantly
people’s health. Legionnaire’s Disease is a potentially
fatal form of pneumonia caused by Legionella bacteria. It

Employers who manage premises with hot/cot water services
must ensure they comply with their duties under law. Under
general Health & Safety law you must; identify and assess
sources of risk, prepare a scheme for preventing or
controlling the risk, implement and manage the
scheme-appointing a person to be managerially responsible,
sometimes referred to as the ‘responsible person’, keep
records and check that what has been done is effective and
if appropriate notify the local authority that you have a
cooling tower(s) on site.
Legal firms are warning that Legionnaire’s disease
convictions will rise, with a possible jail sentence of 2
years and large fines are possible. By following the correct
guidelines set out by the ACoP L8 you will be minimizing
risk of an outbreak but also protecting management and the
company from large fines and in the worse case jail
sentences. Unfortunately you may not always be able to
prevent an outbreak however by following the law in the
correct way the company will not be held responsible or
negligent in a court of law.
